Essa é uma dúvida muito comum para quem está pensando em alugar o seu imóvel, e pode causar confusão se não for devidamente esclarecida. Portanto, a A3 vai te explicar neste texto como funciona essa questão, continue lendo!
Vamos começar com uma breve definição de IPTU de acordo com o site do SERASA:
“ O Imposto Predial e Territorial Urbano é um imposto cobrado de quem tem um imóvel urbano. Pode ser casa, apartamento, sala comercial ou qualquer outro tipo de propriedade em uma região urbanizada. (…) O valor dele varia conforme a avaliação do imóvel. (…) Todo o dinheiro arrecadado com o IPTU fica no município. E, com isso, ele pode ser usado em obras na cidade.”
Se nós formos interpretar devidamente o primeiro parágrafo, ou seja, logo na parte em que está escrito “cobrado de quem TEM um imóvel urbano” nós já conseguimos obter a resposta:
– É o proprietário o responsável pelo pagamento do IPTU, mesmo sendo alugado.
E não existe lei sobre isso?
Sim, existe!
E de acordo com ela, a Lei nº 8.245/1991, o dono do imóvel pode especificar em contrato que o IPTU é responsabilidade do inquilino, assim como outras despesas.
PORÉM,
Dentro Código Tributário Nacional, o proprietário é quem tem a incumbência de pagá-lo.
E caso o pagamento atrase ou aconteça outro tipo de problema, a pessoa procurada e cobrada será o proprietário, e a prefeitura pode tomar as atitudes que considere cabíveis na situação.
Com essas informações nós podemos concluir que: o possuidor do imóvel pode combinar com o inquilino que este é quem deverá pagar o imposto, porém, caso ele não o faça, quem sofrerá as consequências é o dono.
Quais atitudes tomar caso ele não pague?
Primeiro de tudo, a A3 recomenda fortemente que você cheque por si mesmo se o pagamento foi realizado, mesmo que tenha uma relação amigável com seu alugador. Caso ele não tenha feito, antes de tomar uma atitude mais séria, converse educadamente e verifique o que aconteceu.
Entretanto, se inadimplência persistir, você mesmo deve pagar o mais rápido possível para que a dívida não fique acumulada e os juros aumentem, e só após isso tomar atitudes judiciais para ter o seu dinheiro ressarcido pelo inquilino.
Sou inquilino e considero o valor abusivo.
Realmente, os imóveis sofreram reajuste no valor do IPTU, porém se você é quem está de aluguel na propriedade e não consegue ou não concorda com o valor, você não pode simplesmente decidir não pagá-lo!
Converse sobre este problema com o proprietário logo que o imposto chegar para que cheguem a um novo acordo.
Caso nada seja resolvido, você deve imediatamente entrar com um recurso administrativo na Secretaria Municipal da Fazenda antes que a dívida acumule e você possa sofrer uma ação do proprietário. Eles irão averiguar a situação e determinar se o valor está correto ou não.
